NDAA: A Big Victory! Plus, Will Michigan Join Virginia in Defiance?
By Jim Babka
UPDATE: The Michigan legislature's hearing on NDAA will be TUESDAY, SEPTEMBER 25 at Noon. This modified information is also included in the announcement at the end of this post.

(Note: Michigan residents: Be sure to read the special message near the end of this Dispatch.)

We have some BIG news!

As we told you last spring, Judge Katherine Forrest issued an injunction enforcing the legalized kidnapping provisions of the 2012 NDAA (National Defense Authorization Act). Then, on September 12...

She ruled the provisions are unconstitutional.

This is a big victory for America, and for you in particular, because YOU funded the Downsize DC Foundation brief in this case.

And yet...

While we’ve won a victory, it isn’t final. President Obama has appealed Judge Forrest’s decision. Ultimately, who knows how a highly politicized Supreme Court will rule?

Instead of passively waiting for their decision, shouldn’t we make the NDAA political poison?

Shouldn’t we deny our consent to legalized kidnapping?

Shouldn’t those who claim to “represent us” know where we stand?’s Repeal Indefinite Detention campaign has a brief hard-wired message to Congress:

Repeal the detainee provisions of the National Defense Authorization Act of 2012 (Sections 1021 & 1022).

Here’s some additional remarks you can include...

A federal judge has already ruled these provisions are unconstitutional, and they are also clear violations of human rights. Repealing these provisions will...

* Reflect the will of the people;

* Put pressure on the President to drop his appeal and sign the repeal law;

* And put this out of the hands of a highly-politicized Supreme Court.

If you voted for these provisions initially, here’s your chance to redeem yourself. Repeal these provisions!

Please send your letter using’s Repeal Indefinite Detention campaign.

A special note to Michigan residents...

Michigan State Representative Tom McMillin introduced bill H.B. 5768. It would forbid all state and local agencies from assisting federal agents, enforcing the indefinite detention provisions.

It would be another strong denial of consent from the states, much like another, successful effort in Virginia.

Here’s what Michiganders can do...

There will be a State House Oversight Committee meeting Tuesday, September 25 to push forward H.B. 5768.

The public is invited to attend. A large turnout will help get this bill passed.

Here’s is the meeting information:

Tuesday, September 25th 2012
Anderson House Office Building, Room 326
124 N. Capital Ave., Lansing, MI 48909

Thank you in advance if you are able to attend. Here’s is a good summary of our arguments, with a link to the brief we filed:
